Federal Register Update: Block Trades & Privileged Information

The CFTC has requested comments on a proposal to establish appropriate minimum block sizes for large notional off-facility swaps and block trades. In addition, the CFTC is proposing further measures to prevent public disclosure of the identities, business transactions, and market positions of swap market participants.

The CFPB has requested comments on a proposed rule relating to confidential treatment of privileged information. The proposal readopts the CFPB’s interim rule relating to the confidential treatment of information but is modified to provide that the CFPB’s provision of privileged information to another Federal or State agency does not waive any applicable privilege.
