SEC Approves Swap Requirements Proposed Rule

The SEC in open meeting this afternoon approved a proposed rule to set minimum capital and collateral requirements for firms that register as securities-based swap dealers and major swap participants under Dodd-Frank derivatives regulations.

With the approval of today’s proposed rule, the SEC has proposed—and in some cases adopted—substantially all of the rules that create the new regulatory regime for derivatives within their jurisdiction.

The proposed rule will be open to public comment for 60 days after publication in the Federal Register.
